A class action lawsuit was dismissed against Kim Kardashian Jr. and Floyd Mayweather Jr. for their promotion of crypto token Ethereummax. The judge stated that the law “expects investors to act reasonably before basing their bets on the zeitgeist of the moment.”
Crypto Lawsuit Against Kim Kardashian Dismissed
A federal judge dismissed a class action lawsuit against Ethereummax founders and its celebrity endorsers on Wednesday. This included reality TV star Kim Kardashian and boxer Floyd Mayweather Jr. and ex-Boston Celtics star Paul Pierce.
Judge Michael Fitzgerald of U.S. District Court in the Central District of California stated that the claims of the lawsuit raised legitimate concerns about the “celebrities”‘ ability to persuade millions of unsuspecting followers to purchase snake oil with unmatched ease and reach.
While the law certainly places limits on those advertisers, it also expects investors to act reasonably before basing their bets on the zeitgeist of the moment.
Kardashian promoted Ethereummax and the EMAX cryptocurrency token in an Instagram post in June 2021. The reality TV star settled with the U.S. Securities and Exchange Commission (SEC) in October for failing to disclose a $250,000 compensation for touting the crypto token on her Instagram account. Mayweather Jr. promoted the same crypto token at a boxing match and a large Miami bitcoin conference in June 2021.
Attorney John Jasnoch said to Fitzgerald:
If plaintiffs knew the truth about the financial interests of the token promoters and that they were being paid to sell these tokens to them, they would not have paid the same amount for them.
Investors sued Ethereummax’s founders and the crypto project’s celebrity promoters in January after the EMAX cryptocurrency lost 97% of its value. Fitzgerald stated in his ruling that he would let the plaintiffs’ attorneys refile their suit after amending certain of their claims under a variety of statutes cited.
Michael Rhodes was a lawyer for Kardashian and said to CNBC:
We’re pleased with the court’s well-reasoned decision on the case.
